Report on the effectiveness of Directive No 2003/35/EC on public participation
The European Commission has requested Member States to inform on a voluntary basis about the experiences they have made in connection with the application of the Public Participation Directive (Directive 2003/35/EC).
No reporting obligationThe Directive itself does not include an obligation to report. The Directive on public participation implements the relevant provisions of the UNECE Aarhus Convention on the involvement of the public in the preparation of plans and programmes. Most of the plans and programmes in question were already covered by Directive 2001/42/EC on strategic environmental assessment and by the Water Framework Directive (WFD), Directive 2000/60/EC. The remaining areas of the subject-matter Directive are waste, nitrate and air quality.
Experiences on federal and provincial level
The present Austrian report informs about experiences from both the federal and the provincial level. Also a survey of the competent divisions of the Ministry of Life and the offices of the Provincial Governments was conducted.
